The Stow Trial: Teenager found guilty

A SIXTEEN-YEAR-OLD has been found guilty by a jury at the Chelmsford Crown Court.

The teenager, who cannot be named for legal reason was charged with the manslaughter after punching a Polish man, Aradiusz Jozwik in the head at the shopping precinct on Saturday August 27th, 2016.

Jenny Hopkins, Chief Crown Prosecutor for CPS East of England said: “The youth, who was 15 years old at the time of the assault, struck Mr Jozwik from behind. Mr Jozwik fell to the floor, hitting his head and causing injuries from which he died without regaining consciousness.

“In reviewing the evidence we were satisfied there was no intent by the youth to kill Mr Jozwik or that he thought that his actions would result in the death of a man. We decided therefore that the correct charge was one of manslaughter.

“Manslaughter is the unlawful killing of another person with an intention to do some harm or the foresight that some physical harm may result. The court was told the youth put the full force of his body into the punch and he must have been aware when he punched Mr Jozwik in this way that some harm was likely to be caused.

“This was a senseless assault and with that one punch which was over in seconds, the youth was responsible for Mr Jozwik losing his life and causing unimaginable anguish to Mr Jozwik’s family and friends.

“We hope that the jury’s verdict today has brought some comfort to Mr Jozwik’s family and friends that the person responsible for his death has been brought to justice.”

The trial opened on 24 July 2017 at Chelmsford Crown Court, during the trial the teenager pleaded not guilty to the charges.

The incident happened on 27 August 2016 at The Stow shopping centre in Harlow, Essex. Mr Jozwik succumbed to his injuries two days later on 29 August 2016 in Addenbroke’s Hospital, Cambridge.
