Two face fourteen charges over cigarette packaging

TWO men have been charged with a large number of offences in relation to packaging of cigarette packets.

Saiwan Ali, aged 34, of Wellington Court, Wellington Street, Suffolk and Wahib Ali, aged 23, of Amherst Lodge, Harlow have been charged with the following.

Saiwan Ali has been charged as follows:

On 16/05/2018 at 11 Market House, Stone Cross, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 10 packets of Hand Rolling Tobacco, the packaging of which bore the words Amber Leaf, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Gallaher Limited, Virginia House, Weston Road, Crewe, Cheshire, United Kingdom, with a view to you or another selling, offering or exposing for sale or distributing the said goods the said goods.

On 16/05/2018 at 11 Market House, Stone Cross, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 10 packets of Hand Rolling Tobacco, the packaging of which bore the words Golden Virginia, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Imperial Tobacco Limited, 121 Winterstoke Road, Bristol, United Kingdom, with a view to you or another selling, offering or exposing for sale or distributing the said goods the said goods.

On 16/05/2018 at 11 Market House, Stone Cross, Harlow, produced or supplied a tobacco product, namely 6 packets of cigarettes, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour.

On 16/05/2018 at 11 Market House, Stone Cross, Harlow, produced or supplied a tobacco product, namely 20 packets of hand rolling tobacco, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour.

On 11/07/2018 at Amherst Lodge, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 4 packets of Hand Rolling Tobacco, the packaging of which bore the words Amber Leaf, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Gallaher Limited, Virginia House, Weston Road, Crewe, Cheshire, United Kingdom, with a view to you or another selling, offering or exposing for sale or distributing the said goods the said goods.

On 11/07/2018 at Amherst Lodge, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 40 packets of Cigarettes, the packaging of which bore the words Mayfair King Size, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Gallaher Limited, Virginia House, Weston Road, Crewe, Cheshire, United Kingdom , with a view to you or another selling, offering or exposing for sale or distributing the said goods the said goods.

On 11/07/2018 at Amherst Lodge, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely namely 9 packets of Hand Rolling Tobacco, the packaging of which bore the words Golden Virginia, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Imperial Tobacco Limited, 121 Winterstoke Road, Bristol, United Kingdom, with a view to you or another selling, offering or exposing for sale or distributing the said goods the said goods.

On 11/07/2018 at Amherst Lodge, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 80 packets of Cigarettes, the packaging of which bore the word Richmond, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Imperial Tobacco Limited, 121 Winterstoke Road, Bristol, United Kingdom, with a view to you or another selling, offering or exposing for sale or distributing the said goods.

On 11/07/2018 at Amherst Lodge, Harlow, produced or supplied a tobacco product, namely 781 packets of cigarettes, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour.

On 11/07/2018 at Amherst Lodge, Harlow, produced or supplied a tobacco product, namely 89 packets of hand rolling tobacco, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour.

Wahib Ali has been charged as follows:

On 16/05/2018 at 11 Market House, Stone Cross, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 10 packets of Hand Rolling Tobacco, the packaging of which bore the words AMBER LEAF, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Gallaher Limited, Virginia House, Weston Road, Crewe, Cheshire, United Kingdom, with a view to you or another with a view to selling, offering or exposing for sale or distributing the said goods the said goods.

On 16/05/2018 at 11 Market House, Stone Cross, Harlow with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of a business, goods, namely 10 packets of Hand Rolling Tobacco, the packaging of which bore the words Golden Virginia, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely Imperial Tobacco Limited, 121 Winterstoke Road, Bristol, United Kingdom. , with a view to you or another with a view to selling, offering or exposing for sale or distributing the said goods the said goods. Contrary to section 92(1)(c) and (6) of the Trade Marks Act 1994.

On 16/05/2018 at 11 Market House, Stone Cross, Harlow, produced or supplied a tobacco product, namely 6 packets of cigarettes, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour.

On 16/05/2019 at 11 Market House, Stone Cross, Harlow, produced or supplied a tobacco product, namely 20 packets of hand rolling tobacco, that did not comply with the requirements of the regulations in that the external packaging was not plain pantone 448C in colour..

The case has been adjourned to September 3rd at Chelmsford Magistrates Court.

Both have pled not guilty.
