Council take man to court over Tye Green Village ditch

A HARLOW man is being taken to court over an alleged failure to comply with an enforcement notice in relation to a ditch.

Mukesh Popat, aged 58, of Broadway, Tye Green Village has been charged with the following.

On January 1st, 2023 at The Broadway, Tye Green Village, Harlow, you did fail to comply with an Enforcement Notice issued on 11 November 2022 requiring Mr Popat to reinstate a ditch described on that notice and on the land mentioned above.

“The infilling of that ditch being subject to consent before any works are carried out in accordance with section 23 of the Land Drainage Act 1991 and no consent for that works having been obtained by Mr Popat prior to the works taking place
Contrary to section 24 of the Land Drainage Act 1996.

The complainer is Essex County Council.

Mr Popat has pleaded not guilty.

The case has been adjourned August 7th, 2024 at Chelmsford Magistrates Court.

I know this may seem ridiculous to some @Not my King but many years ago I used to live in Primrose Field and if the ditches are compromised in Tye Green Village as has happened in the past, the lower lying properties can and have flooded in the past especially due to the fact that the entire village is built on an underground Spring. It is a horrendous experience to come downstairs in the morning to several inches of dirty water covering your entire downstairs and outside property. Maybe @Not my King would like to foot the bill or help with the cleanup for the residents it could happen to again especially looking at the forecasted weather for the foreseeable.
