Open letter to Councillor Dan Swords, Harlow Council from Jewish Groups

Dear Councillor Swords,

WE write to you as Jewish groups in relation to your actions against Razed Roof following the recent holocaust memorial event on Sunday 25th January in Harlow.

A member of Razed Roof read out the names of several genocides during their performance at the event: “Holodomor, (Nazi) Holocaust, Cambodia, Rwanda, Bosnia, Darfur, Rohingya, Xinjiang and Gaza: 2023: 70,000 Palestinians in the Gaza strip are indiscriminately killed by the state of Israel; up to 90% of the population are internally displaced.” 

Rabbi Irit Shillor who was at the event said in response “…the last statement is a statement of opinion, its not fact. None of these facts have been verified.”

The following day you wrote to Razed Roof, stating you would be taking the following actions:

● A ban on Razed Roof using any council facilities, venues or assets

● Termination of all council in-kind support to Razed roof

● Referring the group to the Charity Commission

● Referring the group to the police “in light of references to a proscribed terrorist

organisation, and the potential commission of criminal offences”

● Raising formal concerns with “relevant statutory authorities, use of disabled

participants….”

● Notifying all third-party funders for whom the council administers grants to Razed

Roof

● Notifying the Community Security Trust of the incident

● Informing the Holocaust Memorial Day Trust

Your letter to Razed Roof concluded by saying “the council has a duty to take a firm and unwavering position to ensure that council-supported events and organisations do not promote hatred, intimidation or extremist narratives” and that “the decisions are not subject to negotiation or appeal.”

Your actions are not only extraordinarily harsh and punitive but also display a cruelty and vindictiveness which is hard to fathom. They also show a disregard for reality, which make you a genocide denier.

For your information:

1. The International Court of Justice ruled 2 years ago there is a plausible case of genocide against Israel, since confirmed by countless genocide scholars, including Jewish experts, the United Nations, human rights organisations, including B’Tselem and Physicians for Human Rights in Israel, and many others.

2. The guiding motto of Holocaust remembrance is “never again”, i.e. never again for anyone. The inclusion of the Gaza genocide, alongside the many others mentioned, was therefore entirely appropriate.

Some of us also held a Holocaust memorial event recently and talked about many of the genocides which have occurred, including in Namibia, Viet Nam, China, Congo, Ireland, Sudan, and yes in Gaza too.

3. Rabbi Irit Shillor‘s comments were incorrect. The 70,000 deaths figure is long known about, and was recently confirmed by the Israeli Defence Force, in the Israeli press.

More recent research, published in the world-renowned medical journal, The Lancet, states that officially recorded deaths are undercounted by a third or more. Rabbi Shillor‘s response is therefore, clearly opinion, not fact.

4. 5. Why was mention of the Palestinian genocide considered outrageous?

The comments made about Gaza are not antisemitic; they criticise the state of Israel, not Jews. The conflation of all Jews with the actions of the state of Israel (as in your letter), on the other hand, is an antisemitic stereotype; it portrays all Jews having a single view or belief.

6. Razed Roof made no reference to any “terrorist organisation”, much less invited support for such a group. This shows a blatant disregard for the truth on your part.

Your actions follow the typical Zionist narrative: denial of the Gaza genocide (when denial of the genocide of Jews by the Nazis is a classic antisemitic trope); conflation of criticism of Israel with antisemitism, and the attempt to suppress all mention of Palestinians. Indeed, you have conflated terrorism with sympathy for Palestinians being killed by Israel.

Your conduct is historically ignorant, and racist against Palestinians (as well as towards Jews). It is acrude attempt to intimidate Razed Roof, as well as any other group speaking the truth about Israel’s genocide.

You have done all this in your official capacity as Council leader. This breaches your duty to adhere to principles of objectivity, integrity, and accountability, as set out in standard codes of conduct and governance principles of the Local Government Association.

Your actions are clearly also an abuse of power. In addition, you ruled out any discussion or appeal against your actions, clearly denying the group due process.

We draw your attention to the fact that the overwhelming majority of comments in the local press in Harlow and on social media about this issue are sympathetic to Razed Roof. They oppose your actions, some doing so very strongly.

We call on you to withdraw all of your actions and issue an apology to Razed Roof. Failing this, we will be lodging a formal complaint with the Council Monitoring Officer and the Local Government and Social Care Ombudsman.

Dan Swords also failed to accurately quote the IHRA Working Definition of Antisemitism. He left out the caveat that criticism of the State of Israel in a similar manner to any other nation is not antisemitic. Clearly, even with Jewish-led organisations in Israel calling out a genocide, it is obvious and fair criticism of Israel to highlight their brutal retribution in Gaza. Dan Swords has overreacted and he should be man enough to admit it. Bring your retribution to an end councillor Swords.

I think that letter says it all - a huge overreaction to the circumstances, punishing a group of innocent disabled kids for no reason. It’s an embarrassment to Harlow Council and especially Dan Swords, whose politics I may not agree with but who is otherwise demonstrably doing more for Harlow than anyone else has in recent memory. I would call on him to put this right and not leave this stain on his otherwise positive record.

Joking aside, I haven't seen much of anything from Razed Roof in regards to this, have they been talking to the council do we know? The answer would seem obvious. Cut the person who deliberatly lied in that they were not going to say what they did and the rest of the group can go back to doing what they do so well, with the support they rightfully have

Thank you, YourHarlow, for publishing the Jewish Groups’ informed and thoughtful response to the appalling and autocratic punishment meted out to the very special and much-respected Razed Roof theatre company. One point made stands out particularly for me: The decisions were initiated and implemented by only one of our elected representatives. Harlow Council is, supposedly, a democratic organisation so where are the other 32 elected councillors? With one exception, Cllr Tony Edwards who has been tirelessly trying to keep hope alive for a reprieve — or at the very least a fair hearing — for Razed Roof, NO councillors appear to have shown any interest. I state this based on my own experience of having written to the Andrew Johnson, Chairperson of Harlow Council, on February 5, with copies to each of my three local ward councillors, and also the Leader of the Labour Group, Cllr James Griggs. AND ANSWER CAME THERE NONE from any of them. Cllr Johnson was A. At the Holocaust event, hosted in the Council Chamber. B. Is a long-serving Harlow councillor and also an Essex County Councillor, so has had lengthy experience of how local government should function. C. Is himself a supporter of arts, cultural and community activities in Harlow. My letter asked Cllr Johnson whether he would be “prepared to work with ALL elected members to resolve this unfortunate situation for the good of our town.” By sharing the letter with ward councillors and the leader of the opposition group on Harlow Council, I was hoping there could be sensible cross-party co-operation to find a way through. I understand council officers have a duty to reply to correspondence; perhaps the council’s compliance officer might advise the policy should be extended to elected members. Now that local elections have been reinstated we might find councillors and candidates knocking at our doors between now and election day in May. The lack of accountability demonstrated by the refusal of one individual to allow democratic debate over this issue could perhaps be discussed on the doorstep? What is the point of local councillors if they have no role in decision-making? Elected representatives need to debate in open session the ethics of denying a group of the town’s citizens access to public buildings, particularly when the organisation they belong to contributes to the wellbeing of our town. Razed Roof affords its members opportunities to partake more fully in social, recreational and educational activities their diverse needs may otherwise exclude them from. I know several Harlow organisations and charities have written to the council expressing support for Razed Roof. Others may wish to, knowing of Razed Roof's wonderful record for more than 30 years.

I am hugely encouraged by this open letter from these groups who know exactly of what has happened, to who and to the genocidal, existential affect on the lives of all concerned, seemingly unlike Councillor Swords. I believe he was relying on the received ill-informed and cretinous opinion of MSM, hoping that this alone would justify his punitive actions. As a composer and former lecturer at Harlow College, not only have I worked with and for the highly/ nationally regarded Razed Roof company for nearly 30 years, I had the pleasure of writing music for a recent Razed Roof performance. The management and staff of Razed Roof work tirelessly and selflessly with people who have learning and/or physical disabilities and are a jewel in the crown of Harlow, who offer inclusive education opportunities for many many people who would otherwise be forgotten by society. These people, staff and students, should be celebrated in their work, not verbally strafed and villified by ignorant and reactionary decisions of those who should know better. The very least that Councillor Swords should do in response to the letter would be immediately reinstated funding and use of Harlow Council's resources to Razed Roof, an immediate retraction of the spurious claims in his communications to the council and people of Harlow, and a sincere apology to all parties concerned. Razed Roof and Harlow deserve so much better.

Well done Mag Barrett and thank goodness for the Harlow Council for Jewish Groups. It has been wonderful to read sane, reasoned discourse on the matter of Razed Roof's banishment. I hope that reparation and large apologies find their way to the Artistic Director and all the Trustees of Razed Roof - and please make that very, very soon.

Well said those Jewish groups. For too long Jewish people have been conflated with the actions of the state of Israel and it's criminal Prime Minister. The actions by public figures such as Cllr Swords have exacerbated this racism. Many Jewish people are horrified by the actions of the state of Israel. It's time Cllr Swords and Chris Vince stopped supporting the Israeli state.

Thank you so much for speaking up, I've been asking for comment from Dan swords repeatedly but have been ignored by him. He is happy to brag about all the amazing things but has never given any update as to what is happening with razed roof, especially as they have been found to do no work doing by Essex police. A really disgusting group punishment for the actions of one individual. Shame on all the councillors, but massive shame on Dan himself.

What a wonderfully written, dignified and powerful letter. Funny how Dan Swords is all too happy to pipe up on social media comments regarding criticism of his 'building Harlows future' regime, and yet, like others have said in their comments on this thread, has categorically ignored any comments of support for Razed Roof or criticism of how he has dealt with this whole sorry state of affairs. I will be very interested to read a response from him now, although I strongly suspect he will remain hidden behind a pile of rubble dug by one of the many JCBs invading the Town. Cllr Swords beiieves that "Building Harlows Future" entails building high rise flat blocks, removing car parks and getting an M&S store in the town. It is of course far more than that, it is about rebuilding communities, which were at the heart of the New Town plan. In one swoop, he has done the opposite of what this town needs more of, scuppered a community group which has served many residents in the town for decades.
