Appeal for calm as Court of Appeal refuses Epping Forest District Council permission to appeal to Supreme Court

THE Court of Appeal has now refused the application of Epping Forest District Council for permission to appeal to the Supreme Court.

No reasons were given. It is now open for the council to ask the Supreme Court itself for permission to appeal against the judgment of the Court of Appeal. The council has consistently opposed the use of the Bell Hotel to place asylum-seekers, which is in breach of planning control and is against the interests of those living in, working in and using the area.


“We believe the Court of Appeal decision to overturn the interim injunction for the closure of the Bell Hotel was wrong. The Court of Appeal judges appear to have placed the Secretary of State’s duties towards asylum seekers above those of the council to uphold the planning system. It is the planning system that provides an orderly forum for local concerns about the use of land to be debated, decided and enforced, consistently with published policies. Overriding that system by forcing the council to accommodate the Secretary of State’s “wider interests” weakens that system, and only serves to encourage disorderly means of expression. This is not the way of the council.

“We represent the interests of local residents. The implications for local democracy and good government are profound if the Home Secretary’s powers trump the statutory responsibilities of councils. However, this is not the end of the matter. We consider we have a strong case for a final injunction. The final injunction hearing is expected to be heard some time in early October. In the meantime, the council is keeping all our options open, including seeking permission from the Supreme Court to appeal against the judgment of the Court of Appeal.”

“As I a walk through Epping people talk to me. There are all shades of opinion, but I sense most residents support our action to close the Bell Hotel. However, I also get a sense that they are tired and need some respite from the disturbances that have taken place in the last few weeks.

“I support the right of local people to peacefully protest. However, following further disturbances and arrests by Essex Police, I am approaching the other group leaders on Epping Forest District Council and other community leaders to jointly ask protesters to reflect on whether they continue with the twice-weekly local protests. If you choose to continue, it should be done considerately and calmly, with awareness of the impact on local residents and the local economy. The people of Epping are under great strain. As schools return this week, I appeal to the protest organisers to show restraint and give our families and children some much needed respite.

“Let the council focus on fighting this case through the courts. We have already made a strong case, and we remain confident in our position as the legal process continues. Make your case to the Home Secretary in Westminster while the council argues for the full injunction at the High Court in October.

“Think of our children and allow local families some space and reassurance as they start the new school year.”

David Foreman, what about all the Antifa that the government pay and transport to these demonstrations to incite anger and conflict and make the protesters look bad. Wake up and realise that the far left are a minority and the good people of this country and fighting for what is right.

Mikel, the same could be said of the socialist worker, stand up to racism and antifa could it not? Those groups could certainly start a fight in an empty room. David, you quote Guardian, I quote Your Harlow. Let's not forget this headline in Your Harlow dated 28/7/2025 "Harlow’s Stand Up To Racism join over 700 marchers in Epping". are you saying that wasn't organised? come come now. When everyone else organises something they are the far right, but when the far left do it it's not organised and they are just "counter protesters who happened to be there?? Anyway, It was expected that the governments appeal would find a way to overule the high courts Decision. It will now move to the supreme court. That's not to say you can no longer protest peacefully but if you wish to support the protest then peacefull protest is the way to do it.

Of course it was organised, you only had to watch the TV coverage of the protest, to see the number of protesters wearing the “Stand up to Racism” tee-shirts, carrying the ready made placards and banners and a number holding the Trade Union banners. Alongside the edges of these protesters were various persons handing these “Stand up to Racism” placards. All basically supporting the Labour Party against the so called right-wing Reform Party.

Martin, you clearly haven't been following my comments as I'm no fan of the Labour government or Chris Vince. Plus, I would remind you that smugness and arrogance, as amply demonstrated in your comment, can deter potential voters. Labour's Neil Kinnock discovered this in 1992 and a good article from the Critic says: "Labour’s misplaced confidence and swagger made the later defeat all the more hard to take." Seamus, the Homeland Party are one of the inheritors of Nazi ideology. There are examples of this, but the one that stands out for me is the comment by their candidate in last May's local elections in Maidstone describing Slavic people as "untermensch" (sub-human). I'm sure you are old enough to remember the programme World at War which gave details of Hitler's and Himmler's Wannsee Conference in 1942 that decided to accelerate exterminations in Eastern Europe that described those Slavic people as Der Untermensch. David, I certainly am aware of the world at war series. A very usefull and informative series but, like most. I'm also aware the same show will garnish different interpretations. I feel the American comedian Reginald D Hunter's opinion on racism in the U.K. is probably closer to the truth than world at war. His opinion was "Britain has racism, but it's not very good at it." Groups like socialist worker and stand up to racism are effectively business's and they push the narrative that there is a far right on every corner. Why? donations mean cash. It is just a business posing as a moral highground. Two years ago they were mad for just stop oil/extinction rebellion. Arrest's started to happen as did jail sentences and where are they now? Donations take a massive dip so they use the old far right cliche' to boost funds again. The U.K. is NOT inherently racist, it would be impossible to achieve the level of multiculturalism we have, if we were racist. What we have is a high tolerance before we snap but when we do, we expect to be listened too and not to be told by elected officials that we are far right if we point out an increasing problem, a problem most first world cultures are experiencing. Which brings us back to the title of the thread in which people are usng the legal system to convey an ever increasing problem. it will be interesting to see the result.
