Case dismissed against Tye Green Village man served with enforcement notice

THE CASE against a Harlow man taken to court over an enforcement notice has been dismissed.
Mukesh Popat, aged 58, of Broadway, Tye Green Village was charged with the following.

On January 1st, 2023 at The Broadway, Tye Green Village, Harlow, you did fail to comply with an Enforcement Notice issued on 11 November 2022 requiring Mr Popat to reinstate a ditch described on that notice and on the land mentioned above.
“The infilling of that ditch being subject to consent before any works are carried out in accordance with section 23 of the Land Drainage Act 1991 and no consent for that works having been obtained by Mr Popat prior to the works taking place
Contrary to section 24 of the Land Drainage Act 1996.
The complainer was Essex County Council.
But on March 27th at Basildon magistrates court, the case was dismissed.
