Old Harlow resident charged with health and safety offences

AN Old Harlow resident has been charged with a number of offences in relation to health and safety.

Philip Hopwood, aged 59, of Hubbards Hall Estate, off Churchgate Street, Old Harlow has been charged as follows:

Between June 1st, 2016 and February 11th, 2017 at Plymouth in the county of Devon, with intent to deceive, made a document so closely resembling a document issued or authorised to be issued under construction work, planning, management & monitoring of that work, to ensure persons not in its employment who may be affected thereby exposed to risk to their Health or Safety., a relevant statutory provision, namely Health & Safety at Work Act 1974, failed to discharge his duty in Section 3(1) of the Act..

Between same dates at Plymouth, being an employer, failed to ensure, so far as was reasonably practicable, the health, safety and welfare at work of all your employees in that you failed to ensure so far as was reasonable practicable, the health, safety and welfare at work of all its employees, in that they were exposed to risks from construction and demolition work including the risks associated with asbestos containing material, and that offence by the body corporate was committed with your consent or connivance or was attributable to your neglect, whereby you as well as the body corporate are guilty of an offence.

Hopwood has been remanded on unconditional bail until his next appearance Chelmsford magistrates court on April 29th.
